The outcome wouldn't have been any different had Sotomayor actually been a member of the court; after all, she's been tapped to replace David Souter, who's always been a reliable liberal vote on the court.

Still, the case points out the inherent silliness that underlies much of the liberal support for strict adherance to affirmative action goals. When a building is on fire, the vast majority of folks won't care about the color of their rescuer. It's likewise foolish to base promotion decisions mainly on whether diversity is served, unless it can be proved the methods used to make those decisions were racially biased."
